Вообще, если транспорт ваш, то заполнение ЦМР - это не прерогатива отправителя, а сервис с его стороны. Он может её заполнить "по поручению" грузополучателя. Но что и как указывать в цмр, решает всё же не грузоотправитель.
У нас возникал как-то вопрос с голландцами по поводу заполнения цмр при отгрузке на базисе FCA. В конце концов мы получили ответ их эксперта:
Тhe completion of the CMR is on the buyer’s shoulders if parties agree to deliver goods on FCA basis. The fact that – sometimes – the seller, in spite of what precedes, does complete the CMR is nothing else as service from his side. FCA, however, dictates that the contract of carriage is not his contract, that the choice of the transport-modality is not his choice and that – as a consequence the completion of his counterparty’s contract is not his obligation. Without judging everyone by the same standards, experience in this connection tells that it has happened that, if the worst comes to the worst, the before-mentioned service of the seller backfires in whatever way as he has meddled with things which are not his concern.
